Milford & Franklin Area Foreclosure Prevention Lawyer
Foreclosure: it's every homeowner's greatest fear. Unfortunately for hundreds of Massachusetts homeowners every year, it's a fear they have to face.
- If you are behind on a house payment
- If you have received a notice from your bank or mortgage lender threatening legal action
- Even if you have been given a date to vacate …
You can still TAKE ACTION to improve your situation.
The moment you file for bankruptcy, any legal action against you is put on hold until the bankruptcy case moves through the court. By discharging or restructuring your debt, you may find that you can afford your mortgage again. Of you may use that time to transition to new housing.

Does the Bank Even Have a Right to Foreclose?
Just because your lender says you are in default, that does not mean you actually are. Ask for a detailed accounting of your loan. Check the accounting for attorneys' fees, late charges, amounts put into escrow and "forced-place insurance" or tax payments. Do you suspect that errors were made? Talk with real estate attorney Ray Mastroianni if you live in Franklin, Bellingham or any town in Metrowest, Massachusetts.
The law requires that lenders give homeowners written notice of their right to cure their mortgage default within 90 days of being notified of the default. Were you provided that notice? If not, we may be able to delay any legal action.
Can You Have a 2nd Mortgage?
If you are upside down on your house because of a second mortgage or a home equity line of credit, you may be able to discharge the 2nd mortgage with a bankruptcy filing. Have liens or attachments on your home prevented you from selling? A bankruptcy filing may be able to remove those liens.
Mortgage Modification
There are several new federal programs available to help people who are current on their mortgages but in financial distress or even upside down, owing more than their home is worth. Learn more about these mortgage modification or mortgage refinancing programs.
